There are few lawyers who understand how the trucking industry works and how the DAC is used to retaliate against truck drivers to prevent future employment in the industry once harassment, discrimination or unsafe operating conditions have been reported. It is up to you to interview any prospective legal counsel before you enter into a contract with them for representation. Also, you should understand that not all employment lawyers will handle both sexual harassment and other trucking employment issues. A lawyer may be licensed in several states or only in one. Make sure you understand if this before choosing representation. Many employment lawyers work on a contingency basis which means they do not get paid unless they win your case. This makes it easier so that you do not have upfront costs but you must be diligent to find qualified representation that will fight your case properly.

Sexual Harassment and Discrimination: Make sure you have accurate documentation of facts and have reported your issues to the carrier human resource department. If you have been subjected to sexual harassment, or assault or you feel unsafe on a truck with a trainer or co-driver, contact law enforcement immediately to report the incident in the jurisdiction the incident occurred. Do not forget to ask for the phone number, name and file number from the responding law enforcement officer. THIS IS CRITICAL!

** Note: Some truck driver training carriers have filters to prevent drivers from getting into executive offices that wish to file a report with the human resource department. This includes directing driver complaints to a “Driver Resource”, “Safety Department”, “Driver Services”, “Driver Council” or various other titles. These people are not the human resource department.
